Refusal to pay    No legislation there sadly ...making off without payment Theft Act 1978 does not apply to sex industry.

s3 (Making off without payment) may not, but s1 (Obtaining services by deception) does and includes 'if you do x, I will pay you'. Typically, it is emphasised that it does not need to be a contract that courts would enforce, such as contracts involving sex, and it has been used against clients paying with dud cheques.

Oral sex of vagina (forced cunnilingus)
Section 2 Sexual Offences Act 2003 Assault by penetration

Hmm, I'm not convinced this is s2 rather than s3 unless there is actual penetration. Ditto the next one.

I have actually had a client refuse to pay me and he called the police on me ! The cheek of it.....he then proceeded to wait for them to arrive when the police came they made him pay me as he had obviously intended not to pay me from the begining (deception  as xw5 said) he was devastated as he thought what i was doing was illegal and they would be on his side ...........he paid up as he didn't want to go to the staiton with them! I have had other people not pay in the past or take the money back and run ( not for years though) but never before or since one phone the police on me !

Thanks for that Ian, the police actually supplied the offence data but I will go back to them & check? Would hate to give inacurate info

'Obtaining services by deception' is now not on the statute as it comes under fraud now but its quite right that if you are given dud cheques etc there is a legal way to get redress

Phoning the police on you!! That made me laugh, as you say, you werent doing anything illegal so good on them for making him pay you.

Oops, yes. The person I am most familiar with who made a habit of paying with dud cheques - http://www.saafe.info/main/index.php?topic=1582.0 - did his first lot before Jan 2007 and was thus charged under the old law.

So, s11 (Obtaining services dishonestly) and/or s2 (Fraud by false representation) Fraud Act 2006.

(Oh, and I laughed too!)

ST, Shelly hasn't been online here since October and she's unlikely to see your post now. Rather than demanding people PM you, why don't you send her a PM instead and then she'll get a notification? :)

No problem - unless a poster is online regularly and likely to see it then it's really better to make direct contact, or you'll likely have a long wait.

Since this isn't a discussion topic nor a discussion section anyway, I'm locking it :).
