You own the copyrights!!!!

Well this would be a definite plus for a lot of people here I'm sure - most photographers are not at all happy to relinquish the copyright on their work to somebody else.

Could you possibly post an idea/copy of the basic text you use on the document for signing this over? It doesn't have to include names or be the exact words, but it could be valuable for members in other areas who could then use it as an industry example when discussing the matter if contacting other photographers.

Photographic release Agreement


This agreement is made between..... And........ for the Photo Shoot (nr of photos.....) dated on..... And includes the transfer of copyright from ......         to ......  on the basis that the payment of ?....   agreed beforehand, has been done in full on the day of the event.

The agreement is made only for the photos taken on....           and paid for.
The Model may use the photographs taken as she/he wishes without seeking any further agreement from the Photograph.
The photograph is therefore not reliable for any damages, infringements or any other acts punishable by law

By this agreement the Model acknowledge his copyrights and the ones of the photographer.
By signing this agreement the model admits that he is over the legal age 18.

The model is getting the copyright for what she is paying for.
Is simple and as agreed I am will not use those pictures for any purposes , this is normal you are getting what you are paying for. I know some directories use the fake photo reports, by not using this photos the model/escort is risk free for that problem. She will use then and can use them as she wishes. So she owns the copyright. Taking some 100-300 photos and actually paying for 5 and own the copyright for the whole session is something that doesn't sound right to anyone does it?

I don't know if you are aware but when ever you are taking a photo shoot the copyrights are owned by the photographer! For the whole session , when he signs a release agreement that is done soley for the photos you are paying for. Those photos he can not use anywhere. The remaining of the photos are in 1-2 cases used to promote his portofofolio. When ever I am using those pictures I  am informing the model. The pictures are used on my website and they are not the ones you have paid for so no copyright infringement done.

As Holly has said, I'm paying for you to take the photos for a given amount of time and I would expect to be given all of the photos, usually on a CD, at the end (which is what happened with the photoshoots I had back in the day when I used photographers, although they didn't sign over copyright which is why I no longer use them). I see no reason for you to retain any images of me after that and I would not agree to any such arrangement either; I'm not paying you so that I can help you promote your business, and I won't tolerate pictures of me popping up anywhere or advertising anything unless I've put them there myself.

Your original post was misleading in that it made it sound as if you were prepared to sign over copyright of our images to us, which was not the case and as I didn't believe for one minute that you would, that was why I asked. And I was right.

I know many glamour Togs and all of them give over a cd of every photo taken as well as up to ten altered photos.  You are charging an average price yet not even giving a CD of all the photos.  Why would the woman allow you to take as many photos as you want and she is only allowed 5 of them and you keep the rest.  Doing it this way, you should be paying them for the photos as they will be more for your benefit than hers as she gets 5 and you get hundreds.

As for copyright, handing over copyright for just 5 photos is ludicrous.  You say it is because she is only paying for 5 photos.  No she is paying for a whole photoshoot.  TB I don't think you are going to get many bookings charging that amount for 5 pics.

I had some done recently of my family  ?95 including three outfit changes, 500 photos on disc and 10 touched up photos.  Oh and my tog signed over copyright for all the photos and the contract listed every photo ID number so there could be  no confusion.

As escorts we like to own copyright to any photos taken of us as we like to know where they are posted and once we retire we can remove them all and know they are not going to pop up at a later date.

Oh and your contract is for male models anyway as is referred to as he.
