Sitemaker ltd is ok BUT they do insist that anyone using their site agrees that all copyrighted material can be used by them as when for promotional purposes by Sitemaker and associates. I am not sure too many girls will be willing to hand over partial control of their pictures to an unknown company

Hi Danielle, the copyright materials can not be used by 3rd party because i pay a hell of a lot of money to protect my customers copyrights!
I do understand what you are saying but i DO NOT USE FREE software to create my websites!
They are all flash based , so even a visitor can't safe your/any pictures on them pc by right clicking on it !
They just dont get the "save as.. " option !

Are you providing the cloud hosting yourself too? If not, is the firm who are OK with adult content? An awful lot of them are not.

Sorry but the Sitemaker you use, whether you pay or not has in their T&C's that they can use all copyrighted material.
It does not matter if it is a flash site or not as it is the sitemaker owners who can use it. You gave the name of the software you use and I checked their T&Cs. By paying to use their sitemaker you agree all images and content can be used by them and their associate companies.

I am not the direct hosting provider but i have a slice of the pie and i can provide a reliable hosting for up to 200+ websites!
There are some guide lines which i need to follow setting up an escort site.
I need to have a splash/intro page or a page where your visitors will go to first. This page will have terms and conditions that state what the site offers and whether it does show images which are explicit in nature. In another words the visitor will need to confirm that they are over 18 before entering the website !
So, its OK to host adult content websites!

You cannot send PMs because Advertisers only have limited use of the forum; basically posting on their own thread in this section or the one above if appropriate. You also cannot post the same link twice, which is why I have removed the one above.
I can't speak for Danielle, but as far as I can see she was not asking whether we are allowed to post other peoples copyrighted material on these sites or whether having one means we relinquish the copyright on our own - what these TACs suggest is that by agreeing to one of these sites we are automatically giving permission for our copyrighted material to be used elsewhere without our knowledge (and Danielle, please correct me if I've misunderstood).

I did understand Danielle's question,
I'm not sure what lead you to think this but in short: NO, this is not correct!
All the contents that are placed on your site are yours and no one but you hold rights to it!

I don't think you did understand the question, or you would not have posted the quote that you did. Once again, nobody has suggested or is suggesting that we will be giving up our intellectual property rights and this is nothing to do with what Danielle asked - nobody is placing the ownership of our advertising material in any doubt at all.
What I suspect Danielle is referring to is the following, which you have apparently not noticed (again, Danielle to correct me if I'm mistaken):
8.2. By uploading any Member Content to SiteMaker, you grant the Company and its successors and assigns, a non-exclusive, world-wide, royalty free, perpetual, non-revocable licence to display and reproduce such Member Content, both digitally and in print, without any duty to account to you, provided that such use shall be limited to use for Sitemaker's promotional purposes only. You further agree that upon posting any Member Content within a private, members-only group on SiteMaker you grant the Company, and its successors and assigns a non-exclusive world-wide, royalty free, perpetual, non-revocable licence to distribute, display, and reproduce such material to other members of that group. You also grant the Company the right to authorise the downloading and printing in whole or in part of any material that you have posted to a group on SiteMaker, by end-users for their personal use.
Please clarify this for us. It looks fairly unequivocal to me (and if you're wondering whether I've picked the wrong site, I found it by Googling the passage you quoted above, so I doubt it).

Perhaps reading all the T&C's would be helpful instead of just the bits you want people to know about.
This actually means anyone using a site made with their sitemaker is giving consent for them to use any photos or content they choose to. Yes the girl would still own copyright but by having a site with them she has given consent for them use use anything they choose to.
You should make this clear to anyone who wants a site built by you that they are giving their consent for their images and text to be used by the company and associates for advertising etc. It is very unfair to charge anyone for a website without first allowing them to decide if they wish their content to be used this way by not informing them it may be
