Hi AnnaBellah,

Just thought I should point out to anyone reading that working as a 'call handler' for an agency on a commission (or even non-commission) basis is causing or citing prostitution for gain under the Sexual Offences Act 2003 http://www.legislation.gov.uk/ukpga/2003/42/section/52  and therefore illegal. You could face a jail sentence, end up in court etc. etc.

It's controlling prostitution for gain (inciting prostitution is a separate offence) but otherwise yes, anybody thinking of getting in touch need to bear this in mind. The maximum sentence on a summary conviction is six months custodial plus a fine and on indictment, whilst it would be unlikely for somebody acting in a 'receptionist' type capacity, it's seven years.

Commission only could also mean that if no punters come you don't get paid a penny.
I'm glad I got all the Cynthia Payne books before the prices rocked to sky high.

Thanks for the feedback specially as I had no idea it was illegal, all I wanted was a receptionist/webmaster who could handle the incoming calls for us and also manage our site with updating blogs and area profiles....seven years sounds very scary

Unbelievable! How can you possibly offer support and protection to the Women that employ you if you dont have the first clue that what you do is illegal?

Can I also add - ignorance is no defence in the eyes of the law so claiming you were clueless wont stop them prosecuting you...

Annabellah from your other posts it seems like your renting our your flat to other Escorts to use for work - I *hope* you know that that's illegal too? You could be done for running a brother if it's your name on the lease. Sorry if I'm pointing out something you already know, but as well as fines and court appearances, I'm pretty sure that the police can seize a large sum from you under POCA.

I understand your shocked however Let me clarify a few things, I was a working girl for a while and only decided to open an agency of my own end of last year as I have worked for many agencies , some thinly disguised as brothels and in most cases have all been run by men. I thought as a woman, I would do things differently where the girls matter and get all the support as a female run agency

In regards to the original advert I posted,  I perhaps made a mistake in wording my original request for a call handler as I was looking for people who had experience working as a receptionist handling booking for the WG

I have had no intention at any point and my original post also reflects this to incite anyone into the trade.  All I was looking for was a receptionist with experience in booking and looking after the website as all my hours every day is spent working on the site, if that is illegal there should be a lot of agency receptionists and webmasters/mistresses behind bars


I've had a look at the relevant legislation provided by Little Miss Misanthropy  http://www.legislation.gov.uk/ukpga/2003/42/section/52 which I have taken the liberty to copy

"Causing or inciting prostitution for gain

[F2(1)A person commits an offence if?

(a)he intentionally causes or incites another person to become a prostitute in any part of the world, and

(b)he does so for or in the expectation of gain for himself or a third person.

(2)A person guilty of an offence under this section is liable?

(a)on summary conviction, to imprisonment for a term not exceeding 6 months or a fine not exceeding the statutory 
maximum or both;

(b)on conviction on indictment, to imprisonment for a term not exceeding 7 years"

I cannot see how my advert has caused or incited any person to become a prostitute as I was looking for someone to take bookings and not actually go out "inciting" prostitution.

However if you believe that I am wrong please don't hesitate to let me know but I would appreciate some constructive feed back

I care about all the people who work with our agency and I do give a toss, perhaps you know how difficult it can be to run a website, update it on a weekly basis, pay the SEO guys out of your own pocket so that your site remains competitive whilst also linking your site to all the individual profiles for each individual directory, classified and review sites and that's on top of taking calls for bookings which is why I was looking for a receptionist.

I believe other businesses and agencies have receptionists/webmasters who handle bookings on a commission basis specially in this downturn

If you believe I'm greedy that is entirely your opinion however I will let you know now that I'm looking at closing down the agency because I can't afford to run it anymore as I'm paying for all advertising, marketing and SEO out of my own pocket

I'm not in it to make quick money otherwise I would not have made such huge losses going into the agency business

I think you should have a firm idea of the wage bracket that you would pay a receptionist as she is contributing her time, so she could very well spend 24 hours per day answering the phones and not a single client turns up, that would mean she wouldn't make a cent. I, having worked as a receptionist for administration centres before think this is a very risky venture.
However, I have worked as an escort in several legalised massage parlours, for agencies and in brothels in Europe and you are not classed as inciting prostitution, as long as you clarify with any women and men calling up that they know the full extent of what is involved. During my first night as an escort,  I was given a one hour briefing on the industry, what to expect, and asked to sign a contract so that I equitted them of all responsibility. I think it is a good idea to draft up some contracts when taking on any girls to work for you, as that way if they are arrested or you are raided or anything happens even if you are sentenced, at least people as well as the authorities would recognise that you did employ the girls of their own free accord. also, the receptionist does not normally give away details via the phone, as when I worked in one brothel I never gave out sexual details via the phone, I told them they had to come in to discuss any services other than massage, if they were ok with that. yes running a business takes a lot of thought

How does your flat not come under the law then.  You say you are renting it to escorts not just one escort to rent the place for just herself with noone else ever using the property.  The law states a brothel is a place used by more than one escort at any time.  This is regardless is only one works one day and another on a different day.  Even if you are just renting rooms out, it is still classed as a brothel. 
If you have found a miracle loophole in the Law please do tell us as most of us would like to be able to legally share a property so that we had help with the bills.

Thanks LaylaBrunei, we always make sure never to give out sexual details as we specify that we only introduce clients to the girls and any services had to be discussed with the girls themselves.
