Tax question
« on: 30 January 2011, 01:41:07 am »
Hi,

I have been escorting on and off part time this year an I have also been traveling quite a bit. I have just realised that I am soon going to have to do my tax return and feel really stupid, but I have been really careless with record keeping. I do know how much I have earned (not heaps - I've only been part time working on and off) and I'm not planning to claim for any deductibles but now I'm freaking out because I don't know how I can prove how much I earned - i.e. I know in my head how much it was but I have no paper trail (apart from bank statements showing what I paid in). I really do want to pay my tax but I am worried that they won't believe me because really I could be just plucking a figure out of the sky and saying that's how much I earned. I wouldn't ever do that, but i'm worried that's what they will think.

Maybe I could just explain this to someone at the tax office, but I also don't really want to disclose what work I've been doing in person. I have another job too which all tax is paid through wages.

Sorry I realise this makes me a bit of an idiot as I could just have recorded each job, would have taken me two minutes. But hindsight is a great thing.

Does anyone have any experience with this? If I just tell them upfront is it likely that they will be understanding or will they think I'm trying it on?

Thanks, L xx

If you're in NZ then you should get advice from people who know the tax system there, but I can give you the UK perspective.

When I submit my tax return, I'm not expected to provide details or evidence of my income and outgoings. Income from self-employment is just one number, and the deductibles are split into a few categories. I'm expected to have all the evidence of course, but that's only required if they want to check up on me at some point.

So I suggest that you write down any specifics that you can remember from the last year and then (assuming you don't need to provide accounts with your tax return), just submit the final number. Chances are you won't have to think about it again. You could try to find out if there's anything more you should do now, if you want. You may be able to talk to your tax people anonymously, or if you don't mind spending the money you could go to an accountant.

Hi Hun

I don't know about the NZ position but if your UK earnings would be subject to the following.

I would strongly suggest you do claim your allowable deductable expenses, as it sets a pattern for future claims at a time that you may be earning more and why pay more tax and national insurance than you are actually required to do?

You state you haven't kept a record of your earnings but if you have put all earnings into your bank your bank statement could be argued to be your record.  A reasonable view has to be taken, the only record you could keep with a cash business such as ours is a hand written note and there isn't any back up evidence so surely your bank statements are your record.  Think of a taxi driver, his record is his daily takings, OK he has further evidence of mileage but how much of that was non-business mileage?  Or a market stall, they don't log down each sale they just take a note of the daily takings.

Anika Mae is correct in that you wouldn't need to submit these records unless the HMRC required you to do so.  However, you need to get into the habit of keeping records to protect yourself as they can be requested at any time believe it or not they can even request to look at your records before you submit your tax return! but I think that is highly unlikely in our case.

I would strongly suggest that, in future, your self-employed earnings are all put thru' a separate bank account than your private one.  After all if you are required to submit your self-employment records and you give them all your private bank statements they are likely to go on a "fishing expedition" through all your financial undertakings rather than just  your business records.  Even though you aren't doing anything you shouldn't you really don't want to give HMRC the opportunity to ask more and more questions, if you were paying an accountant and this happened your fees would be horrendous.

As for self-employment description, I would just use something vague, like therapist or adviser (some escorts like to put themselves done as beauticians etc).

Hope this helps but please remember the filing deadline (and tax payment due date) in the UK is 31st January (Monday) unless your return was submitted to you late but you would have been advised if you have a later filing date.

Hope this helps.

Hi,

Thanks so much for the advice.

I've calmed down a bit now and made a spreadsheet of roughly what dates I worked. Some of it might be a bit off date wise because I'd deleted emails and texts but I did put it all in my bank account so I went and looked back at transactions on online banking so i was able to get a more coherent idea from this. From what I have read online there isn't anything else I need to do, I just need to provide receipts for deductibles and I don't have these but that's ok, I don't mind as long as I get the bill paid because it's my fault for not keeping the proper records.

So I think it should hopefully be ok. I haven't earned a lot at all and I have no assets or anything so hopefully it will all be fine. I am going to be totally meticulous from now on though, I can't believe I was so careless about it.

Thanks again for the advice, xxx

Hello
I've just read the answers which arereally useful as I'm about to start escorting too and was wondering how I go about declaring my income.  As we get paid by cash and don't supply an invoice for our services or indeed get a receipt - is it ok then for us to just keep a log of income and expenses and provide that to HMRC if they ask for it?
Also, what do we call ourselves .... self-employed what ??? anyone have any ideas ?
Thanks very much!
Mari

Yep, that's how we do it.
