I am fuming right now as a photographer has FAILED to return MY photos in a timely manner, even ignoring the email I sent him. I just read on his site that his photos are 'not to be used on any other website and that it is not available to the public".

Well, excuse the **** out of me? Its me in the picture, I should be able to use it wherever the **** I please

Without me, you wouldn't even have my photos

And I think he is holding my photos hostage and not returning them to me because he doesn't want me to use the good ones. I only got 4 of them back so far and they really aren't the ones I really wanted.

I've got to stop dealing with these freelance photographers because they are full of ****ing shit

Joey I am sorry to tell you this but unless the photographer has transfered copyright to you, you have no right to use them on any site.
Even when paying a tog you only pay for his time and a set of prints. This is why you should either use your own camera or find a tog who is willing to assign all copyright over immediately.

1.Who owns the copyright on photographs?
Under law, it is the photographer who will own copyright on any photos he/she has taken, with the following exceptions:

?If the photographer is an employee of the company the photos are taken for, or is an employee of a company instructed to take the photos, the photographer will be acting on behalf of his/her employer, and the company the photographer works for will own the copyright.
?If there is an agreement that assigns copyright to another party.
In all other cases, the photographer will retain the copyright, if the photographer has been paid for his work, the payment will be for the photographer?s time and typically an allocated number of prints. The copyright to the photos will remain with the photographer, and therefore any reproduction without permission would be an infringement of copyright.

I understand you are angry, but unfortunately this is the overriding reason why it is so important that you chooswe a reputable and trustworthy photographer who will not abuse your trust; the copyright of any photograph (or written text, or painting etc etc) is the property of the person who created it, and harsh though it is, they are not YOUR pictures. This is worth remembering for anyone who has thought of bringing a copyright infringement claim; you do actually have to be the copyright owner to do so - if somebody else took your pictures and didn't sign it over to you, you are not.

If you have made a provable agreement with the photographer to the tune of ('I pay you $xxx and in return I will receive X number of finished images chosen by me') then you should have a case for breach of contract if he actually refuses to supply you with the agreed number of pictures. If not, you're stuck.

Apolgies, I will not use the word **** more than once in a sentence. well, they were not paid photos...rather it was TFP, which means 'trade for time' in the photo industry. But it means that I trade my photos for use in his portfolio, and that I get to use them as well. It shouldn't be photographer keeps it and I dont get shit.

I wouldn't be so angry, but there was a similar guy who did this to me last year...he sent me the crappiest photos and kept all the good ones for himself. I couldn't even use the damn things

TFP means time for prints. The tog keeps all copyright you just get samples of the photos.
IN TFP you will never get copyright. These are done free so the tog can add to his portfolio without having to pay a model.
Joey you have no rights whatsoever with these photos and unless you have a contract stating he will give you so many prints he can get away with giving you 4 or 5 as he has kept his end of the bargain by giving you some

Keep my photos my ass!...I need those back or I'll write a horrible review on him to the modeling board. I've already contacted several other models he shot with (I should of done it before) to see what his track record is.

I have worked with better 'togs' than this guy...and they have been very timely giving me the CDs or upload them on box.net. The hell he thinks he is to just keep them? It was a verbal agreement, I need them back OR else
