Help please :-(
« on: 20 September 2011, 01:02:37 am »
For some reason I have been listed as a swinger on www.gooswingers.com & www.lumakita.com using my work pictures (stolen directly from adultwork with the watermark left on  ) and my work mobile!!!

I am trying to contact them to get these listings removed as recently I've been getting a few calls and texts about these adverts.

I've been on both of these websites to find contact information and both of the email addresses shown :- info@gooswingers.com & legal@lumakita.com come back with failed delievery notifications.

Any one got any help/advice they can give me?? It would be greatly appriciated! xx

This is a real long shot and I'm sure better advice is on its way to you any second. But if you cant get a reply from them is it worth telling Adultwork that your pictures and THEIR watermark have been stolen. I wouldnt have thought they will be very happy and they might fight the battle for you?? Like I said, its only a thought.

Also, I used www.whois.net and got the following for BOTH sites. Try an email to them maybe?

Administrative Contact:
   By Arvixe
   Private Registration (domains@arvixe.com)
   +1.8882784939
   Fax:
   PO BOX 14738
   San Luis Obispo, CA 93406
   US

The 'private registration' means that they've paid someone to conceal their contact details on whois. That's standard practice (I hope everyone here does it!), but it means that Arvixe probably won't pass on your email. It might still be worth contacting Arvixe if all else fails. http://www.arvixe.com/contactus.php They will be responsive to DMCA notifications if you want to go down that route.

http://www.lumakita.com/contactus.php says that you can reach lumakita via eva303@hotmail.co.uk

http://www.gooswingers.com/index.php?option=com_contact&view=contact&id=1&Itemid=4&lang=en says that you can Skype them via the username franklin3031

Tastylass is right. You should send them a DMCA takedown notice. I've pulled an example from Google that you can use below:

Quote
Subject: Notice of Copyright Infringement

The copyrighted work at issue is the text that appears on www.mycontent.com/page1.html and www.mycontent.com/page2.html

The URLs where our copyrighted material is located include www.copypaste.com/abc.html and www.copypaste.com/xyz.com

You can reach me at myemail@mycontent.com for further information or clarification. My phone number is +1-202-393-3984 and my mailing address is John Q Public, 323, Park Avenue, Willcity 39232 CA.

The email address of the website owner, who has reprinted our content illegally, is alex@copypaste.com.

I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.

I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

This is the problem with putting ourselves on the WWW... there's always going to be some nobhead stealing our content and reposting it all over the place  ::)

Good luck with getting your pics pulled, hun

A DMCA notice is a waste of time unless the site is a/ hosted in the US, since it's a US law (Adultwork isn't, but the ones mentioned may be, for those not on a BlackBerry and who can check) and b/ you own the copyright to the pictures (ie if you took them, although if they were snaps taken by a friend it would be hard to prove otherwise as you could say they were on timer).

Contacting Adultwork should be your first port of call, since this breaches their terms of use. The hosting company and Google should be next.

Arvixe (the hosting company for gooswingers & lumakita) is US-based, which is why I said they would be responsive to DMCA notifications.
