Disclaimer on website...and website wording...
« on: 24 March 2010, 02:55:27 pm »
I have done a search of the forums but many of the posts are a couple of years old, and I want to be 100% sure that I'm falling on the RIGHT side of the law!

I am going to put something ON THE FIRST/LANDING PAGE along the lines of "don't press the clicky button if you aren't over 18 cos this site is sexy". Is this all I need to cover myself as an independent?

Then within the site itself, I obviously need to talk about what I will/won't do. Can I be graphic, or do I need to use codes and euphemisms? Do I need to state that my site does NOT promote or advertise prostitution? Can I openly 'talk' about what services the money covers? Do I have to go down the "the money is for time and companionship and what happens between 2 consenting adults is their own business" route?

I just don't want to get this wrong and find my web site deleted or worse!

Thanks all :)

Good question about the landing page/over 18 section.  I'm not sure what you have to put legally.
As for the your second question I list services but under my rates I do use the 'money is time and companionship' only line.

Definitely do a landing page. Even if not for legal reasons: it's only fair to warn people before showing them over-18 content! But legally, I'm pretty sure it's highly recommended that you do, too, as all adult content on the Internet seems to follow this guideline. You don't want to go around corrupting a minor (or a busybody parent), after all.

Prostitution is, obviously, legal in this country (unless you're working on the same premises as one or more other escorts or running an agency) but I believe different web hosts take different stances on this. You're not personally breaking the law by admitting on the Internet that you (a UK citizen living in the UK and paying tax etc) are having sex for money but your hosting company might take some random offence. You've probably already checked through all their small print to see if they allow adult content to be hosted on their servers and so you can probably just go by that. Perhaps add in your landing page warning that you're not intending to promote prostitution, just to cover various silly bases of possible complaint, but that's probably not necessary.

I chose the words/euphemisms/graphic content on my site pretty much willy nilly. :D Just whatever felt right at the time! I suppose I feel a bit safe working in a country where I don't have to worry about being arrested by an undercover perv-cop (*eyes America warily*) so I'm happy to stuff my website and blog with details about how covered vaginal penetration will probably occur at some point after ca$h-money is put in my paws. So I would say it's entirely up to you how euphemistic you want to be - most of the uber-klassy Companion-type escorts seem to be extremely vague on their sites and perhaps it adds to their air of mystery and seduction! But I prefer to be straight-forward as there's absolutely nothing subtle about me and I would hate to give anyone the wrong impression.

Anyway, all that said, Anika Mae, xw5 and Amy, among others, know an awful lot about legalities where escorting is concerned so will probably be along shortly to correct all my babblings here. :P

You don't need to pretend you're not selling sex and you can be as graphic as you like. It's possible this could change in future since the current government is trying to make things more difficult for us, but at the moment frank advertising on your website is fine. (Yes I know I do have a disclaimer on my site. I wrote it way back because like most newbies I wasn't sure if I was ok without it, but I wrote it in a style that amuses people so even though I realised years ago that it's not necessary I keep it for the marketing value.)

The landing page disclaimer has two functions. It's to prevent you being accused of being an offensive harlot who's corrupting our nation's youth, and to stop you getting in trouble for making your content available in countries where that sort of thing is illegal. I don't know what the legal status actually is in either of those cases but to cover both you say "don't come any further if this sort of thing is illegal to view where you are, and also if you're under 18 or whatever the equivalent age is in your country". You can also add something about not being offended by sexy things, if you like.

The 'time and companionship .. pretty horny though' one? I thought that was great too, but I can't see it any more.

Anyway, the main reason for splash screens is that if someone does see it and go away, your bandwidth usage (and possible bill) will be lower. Some hosts insist on them, they're a good place to dump those banners, and that's about it.

You'll probably find a substantial number of visitors use a search engine and arrive at another page anyway.
'The Ian formerly known as SW5'. What they said: "Indispensable", "You are our best resource", and (hours later!) "I'm afraid that you're being made redundant..."

Thanks for all the replies :)

How does this sound for the landing page:

This site is intended for people over the age of 18 years (or whichever age you are legally considered an adult in your country of residence). Also, it's only fair to warn you that this site is for people who enjoy the company and curves of a larger lady. If you are comfortable with sexual discussion and saucy pics of a BIG woman, please come on in!

Now to sort the links and banners and the "time & companionship" wording.
