Did I do the right thing ?
« on: 06 September 2019, 11:15:31 pm »
So I went on an outcall today and everything was good until when I was leaving. I always make sure I double check everything is intact and when I looked today the client had taken the money back from my bag maybe when I’d gone to the loo. He started arguing back and forth with me and was not trying to give me my money so in a fit of rage I called my cab, took his phone and told him if he wanted it he should give me my money. Now I’m sitting here regretting it because In my normal head I would’ve just walked out without taking anything. I’m sitting here staring at his stupid phone that I don’t want. What would you guys do in this situation? Is this theft ? Idk what to do xx

He stole your money, so I agree with what you did. I wish I did something like that when a client stole my money the first and only time, exactly same situation. It taught me to be glued to my stuff. You've got big balls BK.

Depending on the phone, aren't you concerned he'll either track the GPS signal or go to the police?

Him going to the Police about his phone, I think not.
Always keep you bag with you at all times, even a pop to the bathroom.
Make sure all your personal belongings are in your bag - money paid, house/car keys 2 mobile phones and a rape alarm. Make sure too that there is no personal info in your bag.

He is a nob and a thief. Can you report him on here in warnings section?

Considering that this is legal there, I'd GO to the cops, explain what happened, give them the phone & have them contact him. Phone's at the station, come by with your $$ & you can have it back!

I mean, is that an option? The chances are of course excellent that he'll never show, but it gets you off the hook for the phone & puts the responsibility ~ as I'm constantly saying ~ back in his lap.

Celeste I do agree completely with the logic behind that.

But in practice it will not work. The police will give him the phone straight back and he will not be charged with theft of money as there is no proof. They probably will not be interested in the theft of the phone (which is still a crime) but remember by taking it there you are confessing a crime. Prostitution may be legal in the UK but theft is not.

Unfortunately in criminal law you can't steal goods to the value of those someone has stolen from you. One offence doesn't cancel out another and the police are not there to mediate disputes between people (as the courts do in civil law and family law matters). They have targets to meet in regards how many offences they charge people with, and they will happily charge you OR him OR both; depending on whether or not they have sufficient evidence, not depending on the morality of the situation.

Keep the phone for a bit in case he pays you off, if not, then get rid of it. As someone else said he will be unlikely to report it. In his mind he's thinking... does he want a court case (remember court records are public) which will include mention of him robbing (and using) a prostitute for the sake of retrieving a £300 phone? I very much doubt it.

If you're freaking out and feel nervous having his phone in your house, chuck it in a river.

Please put him on the the warning threads with city. In case he repeats. And on ClientEye app. Would help us all. Even his AW username too if he booked via there. Vile man.
Was it an out call to private address or hotel?
Deff don’t turn it on, I think that’s when your location is trackable? Just for safety as he already sounds like a terrible person. He may come after you out of spite on your adverts posing as someone new. Be careful. And maybe take extra precautions like names on hotels rooms to call through before and check persons real identity before going. Deposit and proof of own personal address if out call to private address like a bill sent on a photo. I’d be more worried about your safety tbh.

It’s an iPhone XR. I actually contacted the non emergency police line to ask for advice and the lady said someone will be in contact tomorrow and if I’d like to give the phone back to him via post since I know his address I should do so but she made it clear to not contact or meet him in person whatsoever since an argument took place.

I will do that just now. I wanted to earlier but I thought I have his phone so I can’t even post his number but you’re right. I kno a lot of details about him so I’ll put it up.

And to the other people that replied I really appreciate you guys taking time to give me advice. Xx

Ahh good point Lady Frog, I hadn't gone that far in my thinking (obviously, derp). Yeah, I suppose it would dissolve into a he said/she said situation.

He is the thief you just got a small amount of justice by taking something of his. Police will see it is a argument/dispute. You would have been better off calling police when you was there they would have found the money and he would have been in trouble. I know of 2 workers who called police in the past over client not paying up or snatching it back both times client ended up paying it immediately when police arrived and heard what they were doing. One was threatened with a night in the cell and being taken to police station so he paid her apologised and police left.

I reported a theft of my phone by an ex long time ago they did not do anything in the end. I got a crime number did a statement etc but then it never went anywhere as they classed it as a civil dispute etc so it would have been a small claims situation in the end. If it would have been a more straight forward robbery/theft they probably would have taken action.

Has he since contacted you ?
++ Please make a report !
Don’t stress too much, it’s happened now, you can only focus on what comes now : keep calm. If he hasn’t already contacted you then take the messages / calls to come one at a time, calmly dealing with the situation that’s been created. No sense in going off at him about taking the money back now. It’s been done. You got your ‘revenge’ or whatever.
A cool head, a clear and safe resolution is what’s needed now.
I’d advise against physically meeting to do a potential swap of phone for money.
Perhaps you could ask for a bank transfer or gift card of funds and suggest you post back the phone. Get proof of postage (I think you have his address from the outcall?).

Never been in a situation like that. Sounds horribly stressful and I don’t think anyone can judge or scowl your actions at the time. We all do things in the moment.

Has he since contacted you ?

He contacted me earlier and I gave him my details to deposit my money. He just imessaged me again just now saying he’s made the deposit and if he can get his phone back tomorrow. He did send me double the money so that’s a plus but no way I’m meeting him. I’ll post his phone on Monday morning
And just get it over with. Again, thanks for the advice guys xx

Well then. I guess that answers the question: did he actually take the $$? (I'm not doubting you, simply saying, there's guilt $$ if I've ever seen it, haha!).

And double! Nice job!!👏🏻👏🏻

Now take a bit of it & do something for yourself, you need it after the last cpl days.

Before you post it back make sure there’s no way he can reverse the payment once he gets the phone.
What an asshole!
