Bit confused. Hoping someone can clarify
« on: 13 August 2016, 09:17:32 pm »

Hi,

Not sure if this post is in the right section but here goes.

As I am fairly new to the Uk sex industry I've been researching the law on the subject.

From my understanding, its illegal to have 2 sex workers in the same place as its classed as a brothel. Does this mean that both Ladies are breaking the law or is it just the person who is renting? And what about if one worker decides to rent a room to another worker to have a security buddy and reduce costs?
Is there anyway around this? I for one have had a few bad experiences in the past, the worst involving a gun and the last thing I would ever do is work in an apartment whilst alone.

Now this is where I get more confused ... Duos don't seem to be illegal. Is this not a contridiction?

If you are both working from the same premises even on different days it's illegal.
If something is not perceived it doesn't exist.

I think it's just the person whose property it is who is breaking the law.

Lots of things are illegal but people still do them. I think as long as no nuisance/annoyance/harrasment is caused to other people the police mostly have more important things to deal with  :)

Yeah but I would rather be the one renting than the one with the tenancy :) not worth the risk...

I think if the police had the time/inclination/resources/money to go looking for escort girls doing duo bookings together and 'busting' them,  the UK would be a very safe crime free zone...

No, sadly that's not the case.  I shared a rented serviced apartment.  We were both charged with managing a brothel, had our money confiscated and given a fine at court and we both now have criminal records, so bye bye day job for me.

The police occasionally do go on the rounds raiding.  Take Scotland and Northern Ireland for example, they go on a purge then leave alone for ages.

As for having security, I don't know about that.

As Nora said both girls and the landlord could be charged with running a brothel even if he is not aware of you working.
If something is not perceived it doesn't exist.

Although I've never worked in a brothel/massage parlour I do know that in certain areas the police tolerate them as long as they're aren't causing any problems, same with flat/house shares.

So technically hotels or serviced apartments could be charged with brothel keeping too?

If hotels were allowing prostitution then I suppose yes, there was a notorious motel in Essex a few years ago that was full of hookers openly working, the management allowed it for years and they were fined. I suppose serviced apartments too could get in trouble.

An awful lot of places are brothels. When what became the Sexual Offences Act 2003 was being debated, and the penalties for running a brothel were going to be increased, the owners of assorted 'sex on the premises' venues went 'oh shit' and did some lobbying. Hence there are now two offences: the rarely prosecuted 'owning or managing a brothel' and the 'it depends where you are' 'owning or managing a brothel involving prostitution'.

As far as duos are concerned, if both of you go to an outcall it's not a brothel (or, if it is - Max Mosely's flat probably counts, for example - it's not your problem). For incalls, it's who owns and/or controls the place. Who decides who works when? Who does the advertising? Who...? For standard classic brothels, the answers to those are easy and there's usually a clear manager. For two people sharing a flat or a serviced apartment, it can be harder. Certainly the one who signed the lease / contract is in the firing line, but it becomes easier to say 'you both are'.
'The Ian formerly known as SW5'. What they said: "Indispensable", "You are our best resource", and (hours later!) "I'm afraid that you're being made redundant..."

So if I use a hotel room, the hotel owner and myself could effectively both get fined and get criminal record for managing a brothel?

So the only way to not get a criminal record for sure is to work from your own place solely or go to men's houses?

No, only if the hotel knew you were a hooker and the police could prove it, I.e the police inform them of prostition and they allow you to continue working then the hotel or landlord could be charged as they are making a profit knowingly the money is coming from prostition.
