Soliciters ??
« on: 20 May 2022, 07:26:53 am »
I’m not sure if I’ve read correctly , but I’m hoping I have .. but anyhow , maybe some of us have experienced “frenemys” old friends who you now don’t speak to since being in this line of work, this has very recently happened to me , long story short , she’s threatening to tell my family what I do (hubs and kids) am I right in reading you can actually take legal action against this or did I read it wrong? She’s also black listing my name to other customer, not just 1 or 2 tho, and as we work in close proximity it’s a on going thing , my customers will come back to me and tell me she’s been saying this and that, apparently I’m riddled with STD’s and do bb, I don’t retaliate, but I’m sure I read about someone taking legal action against a similar situation.. is this true?

I'm not sure tbh. Maybe deformation of character.

If it’s hearsay, then it will be impossible to prove anything. However, if you have anything in writing with her as the source (so not secondhand from your clients), then yes, I think you might be able to do something as it’s slander and defamation. In the US, you could instruct your lawyer to send a ‘cease and desist’. I am not sure if there is a UK equivalent.

It might come under slander or harassment.

I would speak to NUM for advice then the police if necessary.

I’m sure I read about someone taking legal action against a similar situation..

so did I [removed]🤣

Joking aside yes technically it is slander and that would be grounds for a suing for defamation of character, but I doubt there would be any winners if you went down that road. Giving her attention will be like oxygen to a fire

ps. also the title is slightly confusing, I though this might be about prostituting on the street, not acquiring legal services

Defamation can only have happened if somebody's reputation can be proved to have been harmed by the incident or action of the person concerned in the eyes of a reasonable person (that is an average passer by, not your peers or industry people). In order to prove this you would first need to prove that you had a reputation worth protecting, and the chances of a prostitute being able to demonstrate both that and any subsequent damage to it in court are virtually zero.

I'm sure there will be solicitors welcome to take your money (likely six figures of it) and you might even win eventually years down the line, but back on Planet Earth it's a complete non starter. Write whoever it is off as a tragic shit stirrer like anybody else would, they'll eventually get bored and move on.

Not worth the time or the effort.   Avoid and give her no attention.  Defamation is the only avenue you have here and its a very thin angle you are batting against.  Concentrate on your business and she will be seen as the troublemaker that she is eventually. Carry on smartly.

If you want to take legal action over her just being a cow and telling people you are a sex worker that's not illegal saying the truth but if she was blackmailing you with it and wanted something in return to not say anything then you could go police.

She sounds like just a malicious shit stirrer so might be best to either ignore and see what happens or if she will not stop with her crap and it's becoming harrasment then tell her you will be speaking to police and taking legal action but maybe only if more happens.

She sounds nasty and childish threatening to out you.

I think it's called 'doxing' where you out someone's private life publicly and it's an offence if proved.

Yes i heard of " doxing" but i think it's only certain situations where action can be taken for instance hacking personal information that is not public then posting it all online which causes that company or person distress or danger concerns.

If you just spread around verbally someone is a sex worker not much can be done about that if true unless they go to means of other extreme stalking/harrassing that person then something could be done.
